These terms govern use of this website and, where a licence is in place, the Exiphore platform. Clause 4 is the one that matters most: it states the limits of what a finding from this platform establishes, and we would rather you read it before deployment than discover it in a courtroom.
1. Acceptance
By accessing this website or using the platform you agree to these terms. If you are agreeing on behalf of an agency or organisation, you confirm you are authorised to bind it.
2. Permitted use
The platform is licensed for lawful investigative, forensic and evidentiary work by authorised personnel of the licensed organisation. You are responsible for ensuring your use complies with the law of your jurisdiction, including the law governing evidence handling, surveillance and personal data.
3. Accounts and access
Accounts are issued by your administrator; there is no public registration. You are responsible for safeguarding credentials and for all activity conducted under an account issued to your organisation. Every action is recorded in a tamper-evident audit log, which is a feature and not a contingency.
4. Nature and limits of findings
This is the clause to read carefully.
- The platform produces MEASUREMENTS and reasoning drawn from them. It does not certify authenticity and cannot establish that events depicted in an exhibit did or did not occur.
- A finding that no manipulation was detected is not proof of authenticity. Detection generalises imperfectly to methods not seen before and degrades on compressed and redistributed media.
- An automated result is not an expert opinion. Every finding requires a qualified examiner to review the measurements and record their reasoning before it is relied upon or tendered in evidence.
- An inconclusive result is a substantive finding. It must not be recorded, summarised or testified to as either authentic or fabricated.
- Text-based analysis is triage only and is not sufficient to adjudicate authorship in academic, disciplinary, employment or evidentiary matters.
- Cross-case fingerprint matches are investigative leads requiring corroboration. They are not identifications and must never be presented as such.
You accept that decisions taken on the basis of platform output are yours, made with professional judgement, and that the platform is one input among several.
5. Your data and evidence
The platform is deployed on your infrastructure. You retain all rights in the evidence and case data you process, and you are its controller. We neither receive nor have access to it. You are responsible for the lawful basis on which you hold and process that material, for its security within your estate, and for its retention and disposal.
6. Intellectual property
The platform, its interfaces, documentation and this website are the property of Exiphore and its licensors. A licence grants a right to use, not ownership. You may not reverse engineer, decompile, or attempt to derive the underlying methods, except to the extent that restriction is unenforceable under applicable law.
Third-party components are used under their respective licences, which are recorded in the deployment documentation.
7. Availability and support
Because the platform runs on your infrastructure, its availability is governed by your environment. Support scope, response times and update cadence are set out in your licence agreement, which prevails over this page in the event of conflict.
8. Warranties
The platform is provided without warranty that it will detect every manipulation or correctly classify every exhibit — no system can offer that, and any vendor claiming otherwise should be treated with suspicion. We warrant that it will perform materially as documented. All other warranties are excluded to the extent permitted by law.
9. Limitation of liability
To the extent permitted by law, we are not liable for indirect or consequential loss, or for decisions taken on the basis of platform output without the examiner review clause 4 requires. Nothing here limits liability that cannot lawfully be limited.
10. Changes
We may update these terms and will change the date above when we do. Continued use after a change constitutes acceptance. Material changes affecting licensed customers will be communicated directly.
